POLICY FOR THE TREATMENT OF PERSONAL DATA
(artt. 13 and EU regulation 679/2016)

This policy aims to describe the operating method of the site, referred to the visitors’ (which consult or use it to make orders) personal data processing. This is a policy issued in accordance with Article 13 of EU regulation n. 679/2019 to those who access the site www.el-ko.it.

DATA CONTROLLER

The data controller is EL-KO S.A.S., which is located in Lecco, Via alla Spiaggia 7/A, tax code 00497220160, VAT number 02292020134. Possible data processors will be appointed, upon conferral by the Owner of external assignments for the performance of which it is necessary to share the customer’s data, for the sole purposes related to contracts/relationships that may exist between the parties, among those who present sufficient guarantees to implement appropriate technical and organizational measures so that the treatment meets the requirements of the Regulation and ensures the protection of the rights of the person concerned and after signing by the Manager of a specific contract/addendum to the professional assignment containing the requirements and specifications of the treatment itself.

PURPOSE AND LEGAL BASIS OF THE TREATMENT
Fulfilment of pre-contractual and contractual relationships existing between the parties and fulfilment of rules and legal obligations to which the Data Controller is subject (by way of example, registration to the site, purchase of services, customer assistance in the use of products and services provided by the Company);
purposes other than contractual ones (marketing of company products, sending of newsletters, commercial communications and/or advertising material for services and other company
products).

For the pursuit of the purposes referred to in paragraph a) the processing of personal data of the person concerned is necessary and the consent to the same is discharged directly in the assignment / purchase product. For the treatment of the data of the person concerned concerning the further purposes in comparison to the pre-contractual/contractual ones of which to the point b) it is demanded the express consent of the person concerned, supplied indifferently in papery form or telematically from the same one.

CONFERMENT AND OBLIGATORY OR OPTIONAL NATURE OF DATA

The personal data requested are exclusively those necessary for the fulfilment of the user’s request, in full respect of the principles of adequacy of the treatment sanctioned by the European Regulation. They are therefore mandatory as strictly functional to the execution of the services requested by the user.

In particular:

surname, name, e-mail to register on the site;
tax data for the purchase of products and services provided by the company.

These data, subject to express consent provided in the manner described above, may also be used for additional purposes referred to in letter b) of the preceding paragraph. Each user has the right, however, directly from their personal area of the site, to modulate their consent (for purposes other than contractual) at any time.

TREATMENT MODALITIES

The processing and storage of data will be carried out with the help of automated computer tools and / or paper, such as to allow access by the user / customer to their personal data in our possession, in the manner most appropriate to ensure the integrity, updating, security and confidentiality, also protecting them from unauthorized and / or illegal treatment and loss, destruction or accidental damage.

Without prejudice to the communications that are made in compliance with legal obligations, the data may be communicated to external parties who carry out specific tasks on behalf of the writer upon their express commitment to the protection of your personal data in accordance with the provisions of this Notice and the rules on the Data Processor referred to in Articles 28 et seq. of EU Regulation 679/2016, as well as the applicable legal provisions.

TREATMENT DURATION

The processing of data will take place mandatorily for the entire duration of the relationship established between the parties and, after the conclusion of the relationship/contract in place, to comply with legal obligations of a civil and fiscal nature applicable to the relationship in place, as well as any other fulfillment/obligation of the law which is required of the Owner with regard to the services referred to in point a) while, for the services referred to in point b) subject to express consent, will take place until such consent is revoked by the person concerned.

RIGHTS OF THE INTERESTED PARTY

At any time, the interested party may exercise, by written request, against the Data Controller identified above, all the rights recognized by the applicable European and domestic legislation and in particular by Articles 13, 14, 15 to 22 and 34 of the European Regulation and the national legislation in force, and in particular:

the right to obtain confirmation of the existence or not of data concerning you, even if not yet recorded, and their communication in intelligible form, the right to obtain free access and / or copy of your personal data being processed with the indication of all relevant aspects to the treatment provided by Reg. Eu;
the right to obtain, free of charge, the updating, rectification of inaccurate data, the limitation of processing or, when interested, the integration of data;
the right to object, in whole or in part, to the processing of personal data concerning him/her, even if pertinent to the purposes of collection for legitimate reasons, or to revoke, in whole or in part, his/her consent, where necessary;
the right to complain to a supervisory authority (Guarantor for the protection of personal data) or judicial authority.
